How to get a West Virginia driver's license

This is how the West Virginia Division of Motor Vehicles describes the graduated driver's license for drivers under 18, based on the Driver's Licensing Handbook (revised July 2026). Check the DMV's website for current fees and requirements before you go.

  1. Get your Level 1 instruction permit

    At 15, bring a certified birth certificate, your Social Security number, proof of West Virginia residency, and a parent's consent on form DMV-DS-23P. Pass the vision screening and the knowledge test, which you can also take online before visiting the DMV.

  2. Practice for 180 days

    Drive with a licensed adult 21 or older between 5:00 a.m. and 10:00 p.m. Stay conviction-free for 180 consecutive days and log 50 hours, 10 of them at night, or finish an approved driver's education course.

  3. Pass the road skills test

    At 16, bring a registered, insured, and inspected vehicle and pass the road skills test. You then get a Level 2 intermediate license with nighttime and passenger limits.

  4. Move up to Level 3

    At 17, after 12 months without a conviction on Level 2, you can apply for a Level 3 license at a DMV regional office or testing center.

How old do you have to be for a West Virginia learner's permit?

15. You start with a Level 1 GDL instruction permit, which needs a parent or legal guardian's written consent on form DMV-DS-23P. You may drive only with a licensed driver 21 or older in the right front seat, only between 5:00 a.m. and 10:00 p.m., and with no more than two non-family passengers besides that driver. Applicants 18 and older get a regular instruction permit instead, valid for six months.

What is on the West Virginia permit test?

The knowledge test has at least 25 questions on traffic rules, regulations, signs, and markings from the Driver's Licensing Handbook. You need 19 of 25 correct to pass, and unanswered questions count as wrong when time runs out. You also take a vision screening, where you need 20/40 or better. An audio version is available for people who have trouble reading. If you fail, you can't retest within one week.

How do I get a Level 2 intermediate license in West Virginia?

You must be at least 16 and have 180 consecutive days of conviction-free driving on your Level 1 permit. A parent or guardian certifies at least 50 hours behind the wheel, including 10 at night, or you complete an approved driver's education course. Then you pass the road skills test.

What are the rules for West Virginia Level 2 drivers?

From 10:00 p.m. to 5:00 a.m. you need a licensed adult 21 or older in the car, unless you are going to or from work, a school-sanctioned activity, a religious activity, or an emergency. In the first six months you can't carry non-family passengers under 20, and in the next six months only one. You may not have any measurable alcohol, and drivers under 18 may use a phone only to call 9-1-1.

When can I get a full West Virginia license?

At 17, after 12 months of conviction-free driving on a Level 2 license, you can apply for a Level 3 license. You can also keep your Level 2 license and follow its rules until you turn 18.

What should I bring to the West Virginia road test?

A vehicle with a valid license plate, registration card, proof of insurance, and a valid inspection sticker, with all its lights, brakes, horn, and wipers working.
